As far as I know, there is no near misses as such in VFR, only cases of bad airmanship which can be reported.

As for IFR and under radar control, a near miss is 5 miles horizontally and 1000 ft vertically. Anything closer than that, and an incedent must be declared.

That said, a Near Miss is always a incedent or accident. I just answered the question for a close call, but goffel can just give his Yea or Nea.

A near miss cannot be an accident.... unless the avoidance taken caused one!

It is a reportable incident though....
